Who This Covers
This is Ohga's consumer health data privacy policy. It applies to residents of Washington State and Nevada, and to consumer health data as defined under the Washington My Health My Data Act (RCW 19.373) and Nevada SB 370.
It is a standalone document. Everything else about how Ohga handles your information is in our Privacy Policy, and this policy does not replace it.
Health Data Categories
Ohga collects the following categories of consumer health data:
- Nutrition and dietary information, including photographs of meals you choose to scan;
- Fitness metrics and workout data;
- Sleep duration and sleep stage data;
- Heart rate and resting heart rate;
- Mood and mental wellness entries;
- Weight and body composition data;
- What you tell the AI coach in conversation, by text or by voice, to the extent it concerns your health.
Where the Data Comes From
- What you enter in the app yourself;
- Apple Health and Android Health Connect, only for the data types you grant and only after you grant them;
- Connected wearables and health services you choose to link;
- Photographs you take or select for nutrition analysis.
Purposes of Collection
We collect consumer health data for the following purposes, and no others:
- Providing wellness coaching and personalized insights;
- Personalizing your Ohga experience based on your health goals;
- Delivering the core Services you have requested.
Who We Share It With
We share consumer health data only with the service providers who process it on our behalf so the app can do what you asked it to do, under contracts that limit them to that purpose:
- Perplexity AI — generates the AI coach's responses and nutrition estimates from what you send it;
- AssemblyAI — converts your speech to text when you use voice mode or dictation;
- Amazon Web Services — hosts the Ohga backend and database in United States regions.
Health data collected through Apple Health or Android Health Connect is never used for advertising, never used to train advertising or third-party models, and never disclosed to a data broker.
We Do Not Sell Consumer Health Data
We do not sell consumer health data, as "sell" is defined in the My Health My Data Act. We do not share consumer health data with third parties for advertising or marketing purposes. Because we do not sell it, we do not ask you for the signed authorization the Act would require before a sale.
Your Rights
- Right to confirm whether we collect, share, or sell your consumer health data;
- Right to access your consumer health data, including a list of who has received it;
- Right to withdraw consent for the collection and sharing of your consumer health data;
- Right to delete your consumer health data, including from our backups and from our service providers;
- Right not to be discriminated against for exercising any of these rights.
How to Exercise Your Rights
- Access: Ohga app → Profile → Settings → Privacy → export your data.
- Delete: Ohga app → Profile → Settings → Account → Delete Account, or follow these instructions.
- Withdraw consent: email privacy@ohga.app, or disconnect Apple Health / Health Connect in your device settings to stop that collection at the source.
We respond within 45 days and may extend once by a further 45 days where the request is complex, telling you why. If we deny a request you may appeal by replying to our decision; if the appeal is denied you may complain to the Washington State Attorney General.
Consent
We obtain your affirmative opt-in consent before collecting consumer health data, at or before account creation, through a dedicated consent screen that names the categories of health data collected, the purposes, and the AI processors that receive it. Consent to collection and consent to share with those processors are presented together on that screen and are not bundled into acceptance of our Terms of Service.
